1. Introduction
Welcome to Voca. These Terms and Conditions ("Terms") govern your use of our Voice Survey-as-a-Service (VSaaS) platform and services ("Services") provided by Voca ("Company", "we", "us", or "our"), a company operating under the laws of Israel.
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
2. Service Description
Voca is a Voice Survey-as-a-Service platform that automates customer feedback collection through AI-powered voice conversations. Our Services include:
- AI-powered voice survey creation and management
- Automated voice call distribution to survey participants
- Real-time analytics and reporting dashboard
- Data export and integration capabilities
- Survey customization and branding options
3. Account Registration
To use our Services, you must create an account using Google OAuth authentication. You agree to:
- Provide accurate and complete information during registration
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access to your account
- Be responsible for all activities that occur under your account
4. Payment Terms
Our Services operate on a minutes-based pricing model. You purchase conversation minutes that can be used for voice surveys:
- All payments are processed securely through our payment processor
- Purchased minutes are valid for 12 months from the date of purchase
- Minutes are non-transferable
- Prices are displayed in USD and include all applicable taxes
- We reserve the right to modify pricing with 30 days notice to existing customers
4.1 Refund Policy
We want you to be satisfied with your purchase. Our refund policy is designed to be fair while accounting for the third-party service costs we incur when you use our platform.
Refunds on Unused Minutes
Refunds are available only for unused minutes. Once minutes are used to conduct voice surveys, they become non-refundable because we have already incurred costs from our service providers for those calls.
Example:
If you purchase 100 minutes and use 50 minutes for surveys:
- Eligible for refund: 50 unused minutes
- Not eligible for refund: 50 used minutes (services already rendered)
How to Request a Refund
To request a refund for unused minutes:
- Email us at support@voca-ai.com with the subject "Refund Request"
- Include your account email and transaction details
- We will review your request and respond within 2 business days
- Approved refunds are processed within 5-10 business days to your original payment method
Technical Issues
If you experience technical issues or service outages that prevent you from using the platform, we may credit additional minutes to your account as compensation. Please contact support immediately if you encounter any problems.
Non-Refundable Situations
- Minutes that have been used to conduct surveys
- Minutes that have expired (beyond 12-month validity period)
- Violations of our Terms & Conditions
- Issues caused by factors beyond our control
Processing and Timeline
Once your refund request is approved:
- Refunds are processed within 2 business days
- Refunds are issued to your original payment method
- Allow 5-10 business days for the refund to appear in your account
- You will receive email confirmation once processed
- Unused minutes will be removed from your account upon refund
5. Acceptable Use
You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Use the Services for any illegal or unauthorized purpose
- Conduct surveys that violate privacy laws or regulations
- Make unsolicited calls to individuals who have not consented
- Collect sensitive personal information without proper consent and safeguards
- Attempt to reverse engineer, decompile, or hack the Services
- Interfere with or disrupt the Services or servers
- Use the Services to harass, abuse, or harm others
6. Intellectual Property
The Services, including all software, designs, text, graphics, and other content, are owned by Voca and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services for their intended purpose.
You retain all rights to the survey content, questions, and responses you create using our Services. By using our Services, you grant us a license to process and analyze this data solely for the purpose of providing the Services to you.
7. Data Privacy
We take your privacy seriously. Please review our Privacy Policy to understand how we collect, use, and protect your data. By using our Services, you consent to our data practices as described in the Privacy Policy.
8. Service Availability
While we strive to provide reliable Services, we do not guarantee that the Services will be uninterrupted, timely, secure, or error-free. We reserve the right to:
- Modify or discontinue the Services with reasonable notice
- Perform scheduled maintenance with advance notification when possible
- Suspend access to the Services for security or technical reasons
9. Limitation of Liability
To the maximum extent permitted by applicable law, Voca shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, or data
- Business interruption or loss of business opportunities
- Damage to reputation or goodwill
- Cost of substitute services
Our total liability to you for all claims arising from or related to the Services shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless Voca and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any third-party rights
- Your survey content or conduct of surveys
11. Termination
We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, with or without notice. You may terminate your account at any time by contacting us at support@voca-ai.com.
Upon termination:
- Your right to use the Services immediately ceases
- Unused minutes will be forfeited unless eligible for refund under our Refund Policy
- We may retain certain data as required by law or for legitimate business purposes
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Israel, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Israel.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by:
- Posting the updated Terms on our website
- Updating the "Last Updated" date at the top of this page
- Sending an email notification to your registered email address
Your continued use of the Services after changes become effective constitutes your acceptance of the modified Terms.
